رسالة الكلية لشهرين ابريل ومايو

تمثلت رسالة الكلية في الشهرين الماضيين (ابريل ومايو) بالعديد من الانشطة كالدورات والندوات وورش العمل فضلاً عن البحوث المنشورة في المستوعبات العالمية.

اذ اقام التدريسي في فرع القانون العام (ا.د. بان صلاح عبد القادر) في اليوم الثالث من شهر نيسان ندوة بعنوان اولويات الانفاق العام استهدفت الاساتذة والطلبة وكان الهدف منها التعريف باهم معايير تحديد القنوات الانفاقية وعبر مراحل تاريخية مع ذكر موقف الفقه المالي. وفي اليوم الرابع من الشهر ذاته اقام التدريسي في فرع القانون الدولي (ا.م.د. مصطفى سالم عبد) ندوة بعنوان المعالجات القانونية لظاهرة انحسار الغطاء النباتي / مدينة بغداد نموذجاً استهدف فيها امانة بغداد ووزارة البيئة وكان هدفها المعالجات القانونية لظاهرة انحسار الغطاء النباتي مع اخذ مدينة بغداد نموذجاً.

وفي اليوم السابع من شهر نيسان اقام التدريسي في فرع القانون الجنائي (ا.م.د. قائد هادي دهش) ندوة بعنوان المسؤولية الجزائية الناشئة عن الايذاء المبهج وكانت الفئة المستهدفة هم الاساتذة والطلبة وهدفت الى التعريف بموضوع المسؤولية الجنائية الناشئة عن الايذاء المبهج حيث له اهمية تتصل بحماية الانسان في اهم مقوماته وهي كرامته كانسان. وفي اليوم العاشر من الشهر اعلاه اقام التدريسي في فرع القانون الخاص (ا.م.د. خالص نافع امين) ندوة بعنوان التناقضات الواردة في تعديل قانون الشركات لعام 2019 وكانت الفئة المستهدفة كل المهتمين بقانون الشركات من طلبة واساتذة ومحامين وهدفت الى بيان التناقضات الواردة في تعديل قانون الشركات لعام 2019 وبيان قصور الاحكام التي وردت بالتعديل.

في اليوم الثالث عشر من شهر نيسان اقام التدريسي في فرع القانون العام (م.م. ايثار حسين جواد) ندوة بعنوان تداعيات ازمة كوفيد 19 على تحقيق اهداف التنمية المستدامة استهدفت فيها الشرائح المثقفة من اساتذة وموظفين وطلبة وكان الهدف منها البحث في واقع الدول العربية على مستوى مؤشرات التنمية المستدامة  وبيان اهم التحديات المتوقعة على تحقيق اهداف التنمية المستدامة جراء تفشي فيروس كوفيد 19 ثم صياغة نموذج مقترح داعم لتحقيق تلك الاهداف في المنطقة العربية. وفي اليوم الرابع عشر من الشهر ذاته اقام التدريسي في فرع القانون الجنائي (م.م. دريد وليد نزال) ندوة بعنوان الوساطة الجزائية كبديل عن الدعوى الجزائية وكانت الفئة المستهدفة هم الطلبة والعاملين بالمجال القانوني بشكل عام وهدفت الى التعريف ببدائل الدعوى الجزائية.

اما في اليوم الثامن عشر من الشهر اقام التدريسي في فرع القانون الخاص (ا.م.د. راقية عبد الجبار علي) ندوة بعنوان القانون الارادي واثره على قاعدة الاسناد الخاصة بالعقود وتمثلت الفئة المستهدفة برجال القضاء والقانون والمحاميين والحقوقيين والاكاديميين المهتمين بقضايا القانون والقانون الدولي الخاص وهدفت الندوة الى التعريف بالحالات التي يسمح بها للافراد اخضاع تعاقداتهم لقانون معين يتم اختياره من قبلهم والتعريف بقواعد القانون الدولي التي تحك العلاقات التعاقدية والقانون الواجب التطبيق. اما في اليوم السابع والعشرون اقام التدريسي في فرع القانون العام (م.م. ايثار حسين جواد) ورشة عمل بعنوان الحرية بين التقييد والتنظيم هدفت الى تعريف المشاركين ببعض الحقوق الاساسية وهي حرية الفكر والوجدان والدين والراي والتعبير توضيح الطريقة التي تفسر بها هيئات الرصد الدولية هذه الحريات وكذلك الحدود التي تقيد ممارسة معظم هذه الحريات.

في تاريخ 5/5/2022 اقام التدريسي في فرع القانون العام (م.د. رباب خليل ابراهيم) دورة بعنوان اتفاقية سيداو وملائمتها للتشريعات العراقية والفئة المستهدفة فيها مجلس النواب ووزارة الخارجية وهدفت الى الوقوف على نصوص المعاهدة التي لا تتفق مع المبادئ الدستورية في دستور العراق لعام 2005 ومبادئ الشريعة الاسلامية. وورشة عمل بعنوان قراءة تحليلية لنصوص قانون الاستثمار العراقي النافذ استهدفت هيئة الاستثمار الوطنية وهيئة استثمار الاقاليم وهيئات الاستثمار في المحافظات واساتذة القانون وهدفت الى  الوقوف على مواطن الخلل والقصور في قانون الاستثمار لغرض وضع المقترحات لمعالجة تلك المواطن للوصول الى قانون يحقق مصلحة الدولة والمواطن في بناء مشاريع استثمارية تكون فاعلة في خدمة المواطن وبناء البنى التحتية في الدولة.

وفي الثامن من الشهر, اقام عدد من تدريسي فرع القانون العام (م.د. اندلس حامد عبد, و ا.د. بان صلاح عبد القادر, و ا.م.د. صبا نعمان رشيد, و م.م. ايثار حسين جواد, و م.د. رباب خليل ابراهيم) دورة خاصة بطلبة الدراسات العليا. وفي الخامس عشر من الشهر اقام التدريسي في فرع القانون العام (م.د. سرى حارث عبد الكريم)  دورة بعنوان الجهة المختصة بنظر الطعون الانتخابية وكانت الفئة المستهدفة تدريسي كلية القانون جامعة بغداد فرع القانون العام وتحديداً القانون الدستوري والاداري وهدفت الى تعريف المشتركين بالجهة المختصة بنظر الطعون الانتخابية وفقاً لقانون المفوضية العليا المستقلة للانتخابات رقم 31 لسنة 2019 وتميز هذا الاختصاص عن اختصاص المحكمة الاتحادية العليا بالمصادقة على نتائج الانتخابات النيابية النهائية وفق البند سابعاً من المادة 93 من الدستور.

في السادس عشر من الشهر اقام التدريسي في فرع القانون الخاص (ا.د. حيدر فليح حسن) ندوة بعنوان نية الاضرار بالغير احدى صور التعسف في استعمال الحق – دراسة في ضوء القانون الامريكي استهدف فيها الاساتذة وهدفت الى بيان موقف القانون الامريكي (الفقه والقضاء) من مبدأ التعسف في استعمال الحق , بالذات من احدى صوره وهي (نية الاضرار بالغير) والتي قد تتخذ وسيلة يسعى من خلالها المتعسف في استعمال حقه لتحقيق غاية معينة وقد تكون هي (اي نية الاضرار بالغير) غاية في حد ذاتها وقد تكون وسيلة وغاية معا. في الثاني والعشرون من الشهر اقام التدريسي في فرع القانون العام (ا.د. بان صلاح عبد القادر) ورشة عمل بعنوان الجهات المختصة بنظر الطعون بقرار تقدير ضريبة الدخل استهدفت فيها الاساتذة وهدفت الى التعريف بالجهات المختصة بنظر الطعن المقدمة على قرارات تقدير ضريبة الدخل وشروط الطعن حسب التشريع العراقي.

في الثالث والعشرون من الشهر اقام التدريسي في فرع القانون العام (م.د. سرى حارث عبد الكريم) دورة بعنوان دورة بعنوان التعليق على الاحكام القضائية (القضاء الدستوري انموذجا) استهدفت فيها تدريسي القانون والحقوقيون والمحامونوهدفت الى تدريب الفئة المستهدفة من الدورة على كيفية التعليق على الاحكام القضائية. في التاسع والعشرون من الشهر اقام التدريسي في فرع القانون العام ( م.م. ايثار حسين جواد) دورة بعنوان حقوق المراة بين التشريع الالهي والقوانين الوضعية استهدفت كل افراد المجتمع سيما اساتذة وطلبة الجامعات هدفت الى اعطاء صورة واضحة وموجزة عن حقوق المراة في الاسلام ومواءمتها لطبيعة المراة واهميتها في تحقيق الاهداف الاجتماعية.

The mission of the College in the past two months (April and May) was represented by many activities such as courses, seminars and workshops, as well as research published in International Journals.

  On the third day of April, a lecturer in the Public Law Branch (Prof. Ban Salah Abdel Qader) held a seminar entitled “Priorities of Public Expenditure” targeting professors and students. The aim was to introduce the most important criteria for determining the spending channels and through historical stages, with a mention of the position of financial jurisprudence.  On the fourth day of the same month, a lecturer in the International Law Branch (Assistant Prof. Mustafa Salem Abd) held a seminar entitled “Legal processors for the phenomenon of declining Vegetative cover / the city of Baghdad as a model. in which the Municipality of Baghdad and the Ministry of Environment were targeted, and its goal was legal processors for the phenomenon of declining Vegetative cover and  Take the city of Baghdad as an example.

On the seventh day of April, a lecturer in the Criminal Law Branch (Assistant Prof. Qaid Hadi Dahesh) held a seminar entitled “Penal Liability arising from the pleasant abuse” and the target group were teachers and students, and it aimed to introduce the subject of criminal responsibility arising from this kind of abuse, as it has an importance related to protecting the human being in its most important component, which is his dignity as a human being.  On the tenth day of the month above, a lecturer in the Private Law Branch (Assistant Prof. Khalis Nafea Amin) held a seminar entitled “The contradictions contained in the amendment of the Companies Law for the year 2019.”  Amending the Companies Law for the year 2019 and clarifying the shortcomings of the provisions contained in the amendment.

On the thirteenth day of April, a lecturer in the Public Law Branch (Assistant teacher. Eithar Hussein Jawad) held a seminar entitled “The Repercussions of the Covid 19 Crisis on Achieving the Sustainable Development Goals” in which it targeted the educated segments of teachers, employees and students. The aim was to research the reality of Arab countries on The level of sustainable development indicators and a statement of the most important challenges expected to achieve the sustainable development goals as a result of the outbreak of the Covid 19 virus, and then formulating a proposed model that supports the achievement of these goals in the Arab region.  On the fourteenth day of the same month, a lecturer in the Criminal Law Branch (Assistant teacher.Duraid Walid Nazzal) held a seminar entitled criminal mediation as an alternative to the criminal case. The target group were students and legal professionals in general, and it aimed to introduce alternatives to the criminal case.

On the eighteenth day of the month, a lecturer in the Private Law Branch (Assistant Prof. Raqiah Abdul-Jabbar Ali) held a seminar entitled Voluntary Law and its Impact on the Attribution Base of Contracts. The target group was represented by judges, lawyers, jurists and academics interested in issues of law and private international law.  The seminar aimed to introduce the cases in which individuals are allowed to subject their contracts to a specific law chosen by them and to introduce the rules of international law that govern contractual relations and the applicable law.  On the twenty-seventh of April , a teacher in the Public Law Branch (Assistant teacher. Eithar Hussein Jawad) held a workshop entitled Freedom between restriction and regulation aimed at introducing participants to some basic rights, which are freedom of thought and conscience, Religion, opinion and expression and clarify the way in which international monitoring bodies interpret these freedoms, as well as the limits that restrict the exercise of most of these freedoms.

  On 5/5/2022, a lecturer in the Public Law Branch (Dr. Rabab Khalil Ibrahim) held a course entitled CEDAW and its suitability to Iraqi legislation, and the target group was the House of Representatives and the Ministry of Foreign Affairs It aimed to identify the texts of the treaty that are inconsistent with the constitutional principles of the 2005 Iraqi constitution and the principles of Islamic Sharia. And a workshop entitled Analytical Reading of the Texts of the Iraqi Investment Law in force targeting the National Investment Commission, the Regions Investment Commission, the investment commissions in the provinces and law professors, and aimed at standing on the flaws and shortcomings in the investment law for the purpose of developing suggestion to address these flaws and shortcomings  to reach a law that achieves the interest of the state and the citizen in building investment projects To be effective in serving the citizen and building the infrastructure in the state.

On 8/5/2022, a number of teachers of the public law branch such as (Dr. Andalus Hamid Abd, Prof. Ban Salah Abdel Qader, Prof. Saba Noaman Rashid, and Assistant teacher. Ithar Hussein Jawad, and dr. Rabab Khalil Ibrahim) held a special course for postgraduate students.  On the fifteenth of the month, the lecturer in the Public Law Branch (Dr. sura Harith Abdul Karim) held a course entitled “The Competent Body for Examining Electoral Appeals.” The target group was the teaching staff of the College of Law, University of Baghdad, the branch of public law, specifically constitutional and administrative law. It aimed to familiarize the participants with the competent authority to consider electoral appeals in accordance with the Law of the Independent High Electoral Commission No. 31 of 2019, and this jurisdiction is distinguished from the jurisdiction of the Federal Supreme Court to ratify the results of the final parliamentary elections in accordance to Paragraph Seven of Article 93 of the Constitution.

On the sixteenth of the month, a teacher in the private law branch (Prof. Haider Falih Hassan) held a seminar entitled Intention to harm others, one of the forms of abuse of right – a study in the light of American law in which professors were targeted and aimed at clarifying the position of American law (Jurisprudence and Judiciary)  From the principle of arbitrariness in the use of the right in particular from one of its forms, which is (the intent to harm others), which may be taken as a means through which the abuser seeks to use his right to achieve a specific end, and it may be (the intention to harm others) an end in itself, and it may be both a means and an end.  On the twenty-second of the month, a lecturer in the Public Law Branch (Prof. Ban Salah Abdel Qader) held a workshop entitled “The Competent Authorities to Consider Appeals against the Income Tax Assessment Decision” in which it targeted professors and aimed at introducing the competent authorities to consider the appeal submitted to the income tax assessment decisions and the terms of the appeal According to Iraqi legislation. 

On the twenty-third of the month, A lecturer in the Public Law Branch (Dr.sura Harith Abdul Karim) held a course entitled Commentary on Judicial Judgments (Constitutional Judgment as a model), in which it targeted law teachers, jurists and lawyers, and aimed to train the target group of the course on how to comment on  Judicial decisions .  On the twenty-ninth of the month, A teacher in the Public Law Branch (Assistant teacher. Eithar Hussein Jawad) held a course entitled “Women’s Rights between Divine Legislation and Man-made Laws” targeting all members of society, especially professors And students , and it aimed to give a clear and concise view of women’s rights in Islam and their alignment with the nature of women and their importance in achieving social goals.
